1. Agreement to these terms

These Terms of Service govern your use of the Magic Brush House Painting & Remodeling website and your communications with us through it. By browsing this site, submitting a form or using our chat widget, you agree to these terms.

2. Information on this site

We work to keep descriptions of our services, service areas and hours accurate, but the content on this site is provided for general information only and may change without notice.

Nothing on this website is an offer, a binding quote or a guarantee of price, availability or results. Only a written estimate signed by Magic Brush and the customer creates a binding agreement.

3. Estimates and pricing

In-home and on-site estimates are free within our Central Florida service area. Estimates are based on the conditions visible at the time of the visit and on the scope described by the customer.

If hidden conditions are uncovered once work begins — rot, water damage, failed substrates, code issues or a change you request — we will stop, explain the situation and provide a written change order before continuing. We do not add charges without your approval.

Unless stated otherwise in writing, an estimate remains valid for 30 days.

4. Scheduling and access

Start dates are scheduled in good faith and may shift due to weather, permitting, material availability or conditions at a prior job site. We will keep you informed of any change.

The customer agrees to provide safe, reasonable access to the work areas, along with water and electrical service where needed, and to move or protect valuables and fragile items before work begins.

5. Payment

Payment terms, including any deposit and progress payments, are set out in your written estimate or contract. Final payment is due on completion of the agreed scope unless another schedule is agreed in writing.

Amounts unpaid past their due date may be subject to late charges and collection costs permitted by Florida law.

6. Workmanship and warranty

We stand behind our work. Any workmanship warranty, its length and what it covers are stated in your written estimate or contract.

Warranties do not cover normal wear, settlement cracks, damage from storms, flooding, impact, neglect, alterations made by others, or failures caused by materials or substrates supplied or specified by the customer. Manufacturer warranties on materials pass through to the customer.

7. Cancellation

Either party may cancel a scheduled project with reasonable written notice. If materials have been purchased or work has already been performed, the customer is responsible for those costs.

8. Photography

We may photograph completed work for our portfolio and marketing. Tell us in writing if you prefer your project not be used and we will honor that request.

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any project is limited to the amount paid to us for that project. We are not liable for indirect, incidental or consequential damages.

This website is provided “as is” without warranties of any kind regarding availability, accuracy or fitness for a particular purpose.

10. Third-party links and chat

This site includes a third-party chat widget and may link to other websites. We are not responsible for the content, availability or practices of third-party services. Your use of the chat widget is also subject to our Privacy Policy.

11. Intellectual property

The Magic Brush name, logo, text, photographs and design on this site belong to Magic Brush House Painting & Remodeling and may not be copied or reused without written permission.

12. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Orange County, Florida.
